Twim’O General Terms and Conditions of Use

1. Preamble

Twim’O is an online social network dedicated to real estate, housing, and heritage. It aims to connect individuals, sector professionals, and real estate agents through content, exchange, and opportunities.

2. Contract between Twim’O and Users

The use of the platform implies full and unreserved acceptance of these T&Cs. Twim’O reserves the right to modify them at any time. Users will be informed via notification or email, and the new T&Cs will take effect 15 days after publication.

Any modification to this agreement will take effect in the future and will not apply to past situations. Your right of recourse in the event of opposition to the new conditions is the termination of your account. If you continue to use our Services after notification of a revision, it will be interpreted as tacit approval of said changes.

By using our Services or creating an account, you accept these Terms of Use without reservation. If you refuse, please do not access them. You are free to terminate the Contract at any time by closing your account and ceasing to use our Services.

4. Registration and Access to the Service

4.1 Registration Requirements

Our Services are not designed for users under the age of 18. By using our Services, you agree to:

1. Be at least the Minimum Age of 18.

2. Maintain only one account created under your real identity.

3. Not be currently prohibited or restricted from using our services.

4. Not have been convicted of serious crimes (sexual offenses, major financial fraud, etc.).

Any account creation using false or misleading information constitutes a violation of our terms. You are responsible for maintaining the confidentiality of your account. While you retain ownership of your account, if a third party (such as an employer) pays for your professional services, they may control access to those specific features and receive usage reports.

4.2 Access Levels and Account Verification

The scope of available features is determined by the account type. Professional accounts require verification (e.g., SIRET number, professional ID).

4.3 Paid Offers

• Payment Acceptance: By purchasing a paid service, you agree to pay all associated fees and taxes. Non-payment results in immediate termination of access.

• Automatic Renewal: Subscriptions are automatically charged at the start of each period using the saved payment method.

• Termination: Cancellation must be made at least five (5) days before the renewal date. No pro-rata refunds are provided for current periods.

• Pricing: Twim'O reserves the right to modify rates with prior notice. The standard rate for "Paid" professional accounts is €20 excl. tax (HT) per month.

5. Advertising and Promotion Conditions

• Pricing Models: Costs are dynamic and displayed before launch. Modes include CPC (Cost Per Click), CPM (Cost Per 1,000 Impressions), or Fixed Duration.

• Ad Content Policy: Advertisements must not promote illegal activities, hate speech, discrimination, weapons, or misinformation. Political, religious, and war-related content is strictly prohibited.

• Refunds: Once a campaign has started (generated impressions or clicks), it is due in full. No refunds are issued for early withdrawal or suspension due to policy violations.

6. Use of the Platform

6.1 Published Content and Responsibility

Users are solely responsible for the content they publish. Twim’O is a specialized platform for Real Estate, Housing, and Heritage. The company reserves the right to remove any "off-topic" content (e.g., general politics, non-sector entertainment) without notice.

• License: By posting, you grant Twim’O a worldwide, non-exclusive, royalty-free license to use, reproduce, and distribute your content to operate and promote the services.

• Intellectual Property: Twim’O owns all rights to the platform’s code, design, and branding.

6.2 AI Generation Tools

Twim'O may offer content generation tools (via third parties like OpenAI). Twim'O disclaims all liability regarding the accuracy, reliability, or intellectual property compliance of AI-generated content. Users are responsible for verifying AI results before publication.

7. Member Remuneration

7.1 Influencer Status

Influencers receive a badge and increased visibility. In return, they must:

• Disclose commercial relationships (Transparency).

• Publish at least one relevant post per week.

• Failure to maintain regular, relevant activity leads to immediate loss of status.

7.2 Professional Member Remuneration

Professionals can monetize private Pages or Groups.

• Commission: Twim'O takes a 20% service fee on successful subscriptions.

• Payment: Net income is paid upon request, provided the minimum payment threshold is met.

• Taxation: The professional is solely responsible for declaring and paying all applicable taxes on their earnings.

8. Liability and Warranties

• "As Is" Basis: Services are provided without any guarantee of technical infallibility or uninterrupted performance.

• Limitation of Liability: Twim'O is not responsible for indirect damages, loss of profits, or data loss.

• Financial Cap: Twim'O’s total liability is limited to the fees paid by the user in the relevant period or €1,000, whichever is higher.

9. Termination and Sanctions

Twim'O may suspend or delete accounts for:

• Violation of the T&Cs or applicable laws.

• Prolonged Inactivity: Accounts inactive for more than 12 consecutive months may be deleted.

10. Dispute Resolution

Parties agree to seek an amicable solution through mandatory mediation before pursuing legal action. The Contract is governed by French Law, and any remaining disputes will be handled by competent French courts.

11. Data Protection (GDPR)

Twim'O protects personal data in compliance with GDPR. Users have the right to access, rectify, erase, and object to the processing of their data. Requests can be sent to info@twimo.fr.

12. Liquidation or Cessation of Activity

In the event of Twim’O’s liquidation or cessation of activity:

• No refunds will be issued for unused credits or active subscriptions.

• Users waive the right to any legal action against the company's directors or shareholders for the reimbursement of funds.

• All data and content will be immediately lost upon the shutdown of servers.
